Content Rules for the Solaya Live application

1. General provisions
These Content Rules set out the rules for publishing, sending and sharing content by users within the Solaya Live application.
Every user of the application is required to comply with these Rules. Use of the application constitutes acceptance of the rules below.
2. Nature of the service
The Solaya Live application enables individual 1-on-1 decision sessions with specialists via a text chat and the exchange of attachments.
The service is informational and entertainment in nature. Content provided by specialists does not constitute medical, legal, financial or psychological advice and should not be treated as a substitute for professional help in these areas.
3. Prohibited content
When using the application, it is prohibited to send, publish or share content that:
a) is unlawful under the law applicable in the user's country or in the country where the service is provided;
b) contains threats, hate speech, or incites violence or discrimination based on race, ethnic origin, nationality, gender, sexual orientation, religion, disability or other characteristics protected by law;
c) is offensive, vulgar, obscene or pornographic in nature;
d) constitutes harassment, intimidation, stalking or other forms of persistent abuse of other persons;
e) contains the personal data of third parties without their consent;
f) infringes intellectual property rights, including copyrights, trademarks or trade secrets;
g) constitutes spam, unsolicited advertising, promotional materials or commercial content unrelated to the service;
h) contains malware, viruses, phishing links or other elements that pose a security risk;
i) misrepresents the user's identity or impersonates another person;
j) promotes illegal substances, weapons, gambling or other activities prohibited by law;
k) encourages self-harm, suicide or other behaviour that endangers life or health;
l) contains content that sexualises minors or any materials related to the exploitation of children.
4. User responsibility
The user bears full responsibility for the content they send within the application, including text messages, photos and other attachments.
The user declares that they hold all necessary rights to the content they send and that its publication does not infringe the rights of third parties.
5. Sending photos and attachments
The user may send photos and other files as part of a session with a specialist.
It is prohibited to send:
pornographic materials or those depicting nudity in a sexual context,
photos or materials depicting violence, cruelty or graphic content,
materials containing the personal data of third parties without their consent,
files containing malware or posing a security risk.
6. Protection of sensitive data
Due to the nature of these sessions, the user may voluntarily share information of a personal nature. However, we ask you not to share information beyond what is necessary during a session, in particular special category data (such as data concerning health, religious beliefs, sexual orientation or ethnic origin), unless it is necessary for the session to take place.
7. Content moderation
The Administrator reserves the right to monitor, review and moderate content sent by users in order to ensure security and compliance with these Rules. Moderation may be supported by technical tools; however, decisions to restrict access to the service or block an account are made by a human.
If content is found that violates the Rules, the Administrator may:
remove or block access to such content,
send the user a warning,
temporarily suspend access to the service,
permanently block the user's account,
in justified cases, share information with the relevant authorities.
8. Reporting violations
If you believe that another user of the application is violating these Rules, please report this fact via:
the reporting feature available in the application, or
an email to: kontakt@solaya.live.
Every report will be considered. We will confirm receipt and take appropriate action within a reasonable time. We will inform the reporting party of the outcome of the review.
9. Consequences of violations
Violation of these Rules may result in:
a warning,
a temporary restriction on access to application features,
blocking of the account,
deletion of the account and all related data,
in the case of legal violations — notification of the relevant law-enforcement or other public authorities.
If moderation action is taken, the user will receive information about the reasons for the decision, the measures applied and the possibility of filing an appeal.
The decision to apply specific measures depends on the nature, severity and recurrence of the violation.
10. Appeals against moderation decisions
If you disagree with a decision regarding the moderation of your content, the restriction of access to the service or the blocking of your account, you have the right to file an appeal within 14 days of receiving the decision.
The appeal can be filed by email to: kontakt@solaya.live, providing a description of the situation and the grounds for the appeal.
The appeal will be reviewed by a person other than the one who made the original decision. We will inform you of the outcome of the appeal within 14 days of receiving it.
Notwithstanding the above, the user has the right to pursue their rights through the courts or to use out-of-court dispute resolution methods available in their country of residence.
11. Intellectual property rights
All content and materials made available within the application by the Administrator, including graphic elements, texts, logos and software, are the property of the Administrator or its licensors and are protected by intellectual property law.
The user does not acquire any intellectual property rights to content made available by the Administrator within the application.
12. Changes to the Rules
We may update these Content Rules from time to time. The new version of the Rules will be published in the application. In case of material changes, we will notify users via an in-app notification or email.
